Public notice defects 4 defects▼
The 2023 notice advertised a Guest House. The decision was for a Bed and Breakfast and Guest House — mutually exclusive uses under the Scheme.
The 2025 notice advertised title deed clause B(a) only. The Tribunal decided B(a), B(b) and B(c).
The 2025 comment period ran 29 days. The Bylaw requires 30 days minimum, excluding public holidays.
Neither notice named a measurement, structure or boundary, despite six relaxations to zero metres being sought.
The storey count 4 against a limit of 2▼

The 2012 stamped elevation carries five floor datums: 39500, 42220, 44940, 47490, 49700. The Scheme's own rule, applied to those figures, gives four storeys. The zone permits two.

The uppermost level, roughly 55m², contains a bar, a prep bowl, a games area and a cloakroom. It is drawn without a title, without a level annotation, and allocated to no unit and no parking requirement.
The lowest level opens at grade onto its own patio through sliding doors. No basement determination has ever been made.
The bedroom count 6 declared, 5 in 2025, up to 7 on the drawings▼

The applicant's own 2023 motivating memorandum states "there are 6 bedrooms in the complex." The 2025 layout plan declares 5. No floor plan comparing the two has been produced.

The Residential Unit alone receives two parking bays where every other unit receives one, consistent with more than one bedroom there.
The uppermost level, fitted with a bar, a prep facility and a lounge, appears in no bedroom count on either application. On a plausible reading of the applicant's own labelling, the number of sleeping-capable spaces could run as high as seven.
At any confirmed count above six this cannot lawfully be a Bed and Breakfast. Absence of a resident operator independently bars both the Bed and Breakfast and Guest House routes. A whole-home Holiday Unit carries no bedroom cap but requires its own consent, which has never been sought.
Records withheld under section 119 still unproduced▼

Section 119 declares these automatically available. Requests were made regardless. Nothing has been produced: the 1998 and 2012 approval files, the Occupation Certificate and its inspection records, the engineer's stability report, the complete 132/2025 application, the Registrar's compliance assessments, the response to objections, the June 2025 notice terms, the appeal register, and the six organ-of-state comment letters.

Section 90 enforcement status 507 days overdue▼
Primary anchor, 2 Feb 2025. 60-day period expired 3 April 2025. 507 days overdue.
Secondary anchor, 8 Jul 2025. 60-day period expired 6 September 2025. 351 days overdue.

No section 90(3)(a) acknowledgement was ever received. No section 90(5) outcome has ever been reported.

February 2024: a remedy offered and a report made Predates the current s90 complaint▼
Naresh put section 89(2) of the Bylaw to the Municipality directly in writing on 16 February 2024, service disconnection without a court order where irreparable harm is caused. No answer addressing the provision was ever received.
The same email reported a fugitive from a SAPS Gauteng warrant sheltering at the property via the on-site manager, arrested by SAPS Margate on the premises, permitted to remain after arrest and bail. Outcome unknown.
The single ask One request▼

That the Municipality be directed to conduct and document a full building control assessment of Erf 44 Trafalgar, measured against the approved plans, and report the outcome in writing by a stated date. This is the exercise it performed on the complainant's own property in 37 days. It has not performed it on Erf 44 in over three years.
